Terms of Service Agreement

By accessing and using airenvandevoort.com, you agree to comply with these Terms & Conditions. If you do not agree with any of these conditions, you are not permitted to use or access the Airen Vandevoort website. The content and materials on this website may be protected by applicable copyright and trademark laws.

DEFINITIONS

“The Photographer” refers to Airen Vandevoort. “The Client” refers to any individual, group, or entity that enters into a contract with the Photographer for photography services.

DEPOSIT AND PAYMENT

A non-refundable deposit is required at the time of booking to secure the session. This deposit ensures the Photographer’s time and services for the scheduled session. In the event of cancellation, the deposit will not be refunded or transferred. If a session is postponed, the deposit will be applied to the new date, provided the Photographer is available.

The remaining balance for the session must be paid on or before the scheduled date. No images will be delivered until all payments are received in full. Payment for any additional images, prints, or albums must be made at the time of ordering.

GRIEF EMBODIMENT SESSIONS & LEGAL NOTICE

The Photographer provides a compassionate and supportive space for those processing grief through photography. However, the Photographer is not a licensed therapist and does not provide professional mental health services. If a Client experiences emotional distress before, during, or after the session, they are encouraged to seek support from a licensed mental health professional. By booking a session, the Client acknowledges that the Photographer’s role is solely artistic and supportive, not therapeutic or clinical.

Some sessions may involve artistic nudity or deeply personal imagery. Clients acknowledge that they are participating voluntarily and without coercion. The Photographer retains the right to use images as part of their artistic portfolio and public work. If a Client wishes to opt out of public use, they must submit a written request before or within 7 days of receiving their final images and the Photographer will honor these requests and ensure that the images remain private

MODEL RELEASE & IMAGE USAGE OPT-OUT

The Client grants the Photographer full permission to use images from the session for artistic and promotional purposes, including but not limited to:

· Art galleries & exhibitions

· Publications (print & digital)

· Online portfolios & websites

· Social media & marketing materials

Clients who do not wish for their images to be shared publicly must submit a written opt-out request form* before or immediately after the session. The Photographer will honor such requests and keep the images private. *Photographer will provide form at clients request.

COPYRIGHT NOTICE & IMAGE USAGE

The Photographer retains full copyright to all images and has the sole right to reproduce, distribute, and display images at their discretion unless an opt out request form is on file.

The Client is obtaining prints for personal use only and shall not sell, reproduce, or authorize any reproductions thereof by third parties without prior written permission from the Photographer. Clients may not download, copy, print, screenshot, or manipulate the Photographer’s images in any way without permission.

EXHIBITION & PUBLICATION RIGHTS

The Photographer retains the right to submit and display commissioned work in galleries, competitions, online portfolios, and publications. If a Client wishes to restrict public display, they must submit a written request prior to the session.

ARTISTIC DISCRETION & CLIENT EXPECTATIONS

The Client acknowledges that all images are created as fine art, with the Photographer exercising full artistic discretion. While minor retouching may be provided, the final images will reflect the Photographer’s unique artistic style and vision. Requests for alterations that significantly change the integrity of the artwork will not be accommodated.

RETOUCHING

All images will be adjusted for skin blemishes, exposure, brightness, contrast, and sharpness at the Photographer’s discretion. The Photographer’s judgment regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct.

The Client does not have permission to alter or edit the final photographs in any fashion, including adding filters or other modifications.

LIMITED EDITION & PRINT SALES POLICY

The purchase of a print or fine art photograph does not grant the Client any copyright or reproduction rights. The Photographer retains full copyright and reserves the right to create and sell additional prints unless otherwise stated in a separate limited-edition contract.

Limited edition prints are numbered and signed by the Photographer. Once an edition sells out, no further prints of that image will be produced in that format or size. However, the Photographer may sell the image in alternative forms (e.g., books, postcards, smaller prints). Artist proofs may be created at the discretion of the Photographer.

IMAGE ARCHIVING

All final images will be stored and archived by the Photographer for one (1) year. After this period, the Photographer is not responsible for maintaining copies of the Client’s images.

LIABILITY FOR MISUSE OF IMAGES BY THIRD PARTIES

Once an image is publicly exhibited, published, or sold, the Photographer is not responsible for any third-party misuse, unauthorized sharing, or copyright infringement by external entities. The Photographer will take legal action in cases of direct copyright violations but is not liable for unauthorized digital reproduction by third parties.

FAILURE TO PERFORM

If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond their control, or due to the Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement.

This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or computer malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer.

In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

CONCERNS & DISPUTE RESOLUTION

Clients must submit any concerns regarding their images in writing within 14 days of receiving the final gallery. The Photographer will work in good faith to address any issues, but refunds or re-shoots are granted at the Photographer’s discretion.

Any disputes shall first be attempted to be resolved through mediation. If mediation fails, disputes shall be resolved in a court located in Yamhill County, under the laws of Oregon.

PHOTOGRAPHER CREDIT LINE & COPYRIGHT NOTICE

The Photographer asserts both their moral right to be identified as the author of their work and the right to a credit where possible.

When posting images online, Clients agree to include a credit line such as:

Photography by Airen Vandevoort or @airenvandevoort on social media.

If a required credit line or copyright notice is missing, the Client agrees to pay a fee for the loss of recognition or lack of copyright protection.

AGE REQUIREMENT & PARENTAL CONSENT (IF APPLICABLE)

All Clients must be 18 years or older to participate in sessions.

GOVERNING LAW & FINAL AGREEMENT

This agreement shall be governed by the laws of Oregon in the United States.

By booking a session with the Photographer, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
